Shop and Establishment Registration in Rajasthan

Almost every commercial premises in Rajasthan — shop, office, showroom, restaurant, coaching centre or godown — must register under the Rajasthan Shops and Commercial Establishments Act, 1958 within thirty days of opening.

What the registration is

Registration under the Rajasthan Shops and Commercial Establishments Act, 1958 is filed with the Labour Department, not with a tax office, and is due within thirty days of the establishment commencing work. The certificate it produces is what banks, landlords, FSSAI, municipal bodies and tender committees accept as proof that the establishment exists at the address you claim.

Since notification G.S.R. 43 dated 26 November 2019 the fee is a one-time payment and the certificate does not expire — a point most published content still gets wrong. Who has to register

The Act attaches to the establishment rather than to the workforce, so there is no minimum employee count. Manufacturing units above the prescribed thresholds go down the Factories Act route instead.

The fee, the slabs and the renewal myth

The one-time fee is set by employee headcount, starting at ₹5,000 for establishments with up to ten employees and rising through slabs to ₹1.5 lakh at the top. Once it is paid the certificate continues indefinitely; there is no five-year renewal to diarise and no annual fee. The single event that brings you back to the department is a rise in headcount into a higher slab, when an amendment is filed and the difference paid.

How the filing is done

Registration is entirely online through the Labour Department Management System, reached with a Rajasthan single sign-on ID. We complete the Form 1 particulars — employer and manager names, establishment name and postal address, nature of business, date of commencement, employee numbers and weekly closing day — upload the supporting documents and submit. The system generates an LDMS application number, which we track and use to answer any query raised before the certificate is issued.

What comes after the certificate

Registration is the start of the obligation, not the end of it. Every employee must be issued an appointment letter with a copy filed with the area Labour Inspector, daily and weekly hours are capped, overtime is payable at the applicable rate, and one paid rest day a week is due on rotation. Registers of employment, wages and leave have to be maintained and produced on inspection.

The State Government's notification of 3 July 2026 released registered establishments from the fixed opening and closing hours and from the compulsory weekly closing day. That is what permits extended and continuous operation, but the exemption is conditional and breaching any condition voids it.

Frequently asked

Who has to register?+

Practically every shop, office, showroom, restaurant, hotel, coaching centre and godown in Rajasthan. The Act applies to the establishment itself, so there is no minimum employee count — a proprietor working alone from a commercial office is covered.

How long do I have after opening?+

Thirty days from the date the establishment commences work. Filing later is still possible but attracts late-fee loading on the registration.

Does the certificate need renewing every five years?+

No. Since notification G.S.R. 43 dated 26 November 2019 the fee is a one-time payment and the certificate continues indefinitely. Content quoting a five-year validity is describing the pre-2019 position.

What does the government charge?+

A one-time fee set by employee headcount, starting at ₹5,000 for up to ten employees and rising through slabs to ₹1.5 lakh. It is paid at actuals and is separate from our fee.

What if my headcount goes up?+

Crossing into a higher slab requires an amendment and payment of the difference. It is the one event that brings you back to the Labour Department after registration.

Do factories register under this Act?+

No. Manufacturing units above the prescribed worker and power thresholds are licensed under the Factories Act instead. We tell you which route applies before filing.

Can my shop stay open every day now?+

The State Government's notification of 3 July 2026 exempts registered establishments from fixed opening and closing hours and from the compulsory weekly closing day. The exemption is conditional — each employee still gets a paid weekly rest day, hours remain capped, overtime is payable and appointment letters must be issued.

Is the certificate enough for a bank account?+

Banks usually want two proofs of business existence. The shop and establishment certificate is one of the strongest; Udyam registration or a GSTIN generally completes the set.
